Terms of Service

Last updated: 22 October 2026

These Terms of Service ("Terms") govern your access to and use of the website at nskaa.ltd (the "Site") and any related services provided by NSKAA LTD ("NSKAA", "we", "us" or "our"). Please read them carefully. By accessing or using the Site you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Site.

1. Acceptance of terms

By accessing or using our Site and services, you confirm that you are able to form a legally binding contract with NSKAA LTD and that you accept these Terms. These Terms apply to all visitors, users and others who access the Site. If you are using the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms, and "you" refers to that organisation.

2. Definitions

  • "Content" means all text, graphics, logos, images, code, designs and other material made available on the Site.
  • "Services" means the mobile application design, development, publishing and maintenance services offered by NSKAA LTD.
  • "Client" means any person or organisation that engages NSKAA LTD to provide Services under a separate agreement.
  • "Project Agreement" means the separate written agreement, statement of work or proposal that governs a specific engagement.

3. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Site or engage our Services. By using the Site you represent and warrant that you meet this requirement and that all information you provide to us is accurate and current.

4. Our services

NSKAA LTD designs, develops, publishes and maintains mobile applications and related software for the iOS and Android platforms. The Site itself is provided for general information about NSKAA LTD and to help you contact us. Nothing on the Site constitutes an offer capable of acceptance, a binding quotation, or professional advice. Any delivery of Services is governed by a separate Project Agreement.

5. Project engagements

Where you engage us to carry out work, the scope, deliverables, timelines, acceptance criteria and fees will be set out in a Project Agreement. In the event of any conflict between these Terms and a signed Project Agreement, the Project Agreement prevails for that engagement. Estimates and proposals are indicative only until confirmed in writing by both parties. Changes to agreed scope may affect timelines and fees and will be handled through a written change request.

6. Fees & payment

Fees for Services are as stated in the applicable Project Agreement. Unless otherwise agreed, invoices are payable within the period stated on the invoice. We may suspend work or withhold deliverables where undisputed invoices remain unpaid. Fees are exclusive of any applicable taxes, third-party platform charges, developer-account fees, or licence costs, which are your responsibility unless expressly stated otherwise.

7. Client responsibilities

Where we provide Services to you, you agree to provide, in a timely manner, the materials, access, approvals, feedback and information we reasonably need. You are responsible for ensuring that any content, data or materials you supply to us do not infringe the rights of any third party and comply with applicable law. Delays in providing what we need may affect delivery timelines.

8. Acceptable use

When using this Site, you agree not to:

  • use the Site in any way that breaches any applicable local, national or international law or regulation;
  • use the Site in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
  • attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to it;
  • introduce viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful;
  • attack the Site via a denial-of-service attack or a distributed denial-of-service attack;
  • copy, reproduce, republish, scrape or redistribute Content except as expressly permitted in these Terms.

We may report any breach of this section to the relevant authorities and cooperate with them, and may suspend or terminate your access to the Site.

9. Intellectual property

Unless stated otherwise, all Content on this Site — including the NSKAA name, logo, text, graphics and page design — is owned by or licensed to NSKAA LTD and is protected by copyright, trade mark and other intellectual property laws. Ownership of intellectual property created during a Client engagement is governed by the relevant Project Agreement; absent any express term, pre-existing materials and tools remain the property of their original owner.

10. Licence to use the site

We grant you a limited, non-exclusive, revocable licence to access and view the Site and to print or download extracts for your own personal, non-commercial use. You must not use any Content for commercial purposes, nor modify, adapt or create derivative works from it, without our prior written permission. All rights not expressly granted are reserved.

11. Third-party platforms

Our Services involve publishing to third-party platforms such as the Apple App Store and Google Play, and may rely on third-party tools, SDKs and services. Those platforms and services have their own terms, guidelines and policies, which apply in addition to these Terms. We are not responsible for the content, policies, decisions, availability or acts of any third-party platform, including any decision by a platform to reject, remove or delay an app.

12. App store compliance

Apps distributed through third-party stores must comply with the applicable store review guidelines and developer agreements. While we build apps with those guidelines in mind, we cannot guarantee that any app will be approved, or that approval will be maintained, as platform rules change over time and are applied at each platform's discretion. You are responsible for holding the relevant developer accounts unless we agree otherwise in writing.

13. Warranties & disclaimers

The Site is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we exclude all implied warranties, conditions and terms, including any implied warranties of satisfactory quality, fitness for a particular purpose and non-infringement, in relation to the Site. We do not warrant that the Site will be uninterrupted, error-free, secure or free from viruses.

14. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Subject to that, to the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, goodwill, data or anticipated savings, arising out of or in connection with your use of the Site. Our total aggregate liability in connection with the Site is limited to £100. Liability arising from a Client engagement is governed by the limitation provisions in the applicable Project Agreement.

15. Indemnity

You agree to indemnify and hold harmless NSKAA LTD, its officers, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

16. Confidentiality

Each party may receive confidential information from the other in the course of an engagement. Each party agrees to keep the other's confidential information secret, to use it only for the purpose of the engagement, and not to disclose it to third parties except as required by law or as permitted by the disclosing party. This obligation survives termination.

17. Data protection

We process personal data in accordance with our Privacy Policy and applicable data protection law, including the UK GDPR and the Data Protection Act 2018. Where we process personal data on behalf of a Client, the terms of that processing are set out in the relevant Project Agreement or a separate data processing agreement.

The Site may contain links to third-party websites and resources provided for your convenience. We have no control over the contents of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of any link does not imply endorsement by NSKAA LTD.

19. Availability of the site

We do not guarantee that the Site, or any Content on it, will always be available or uninterrupted. We may suspend, withdraw, discontinue or change all or any part of the Site without notice. We will not be liable to you if, for any reason, the Site is unavailable at any time or for any period.

20. Termination

We may terminate or suspend your access to the Site immediately, without prior notice, if you breach these Terms. On termination, the rights granted to you under these Terms will end. Provisions that by their nature should survive termination — including intellectual property, confidentiality, disclaimers, limitation of liability and indemnity — will survive.

21. Force majeure

We will not be in breach of these Terms, nor liable for any failure or delay in performance, caused by events beyond our reasonable control, including acts of God, failure of utilities or networks, cyber-attacks, changes in law, acts of government, or the acts or omissions of third-party platforms and suppliers.

22. Changes to these terms

We may revise these Terms from time to time. The most current version will always be posted on this page with its effective date. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms.

23. Governing law & jurisdiction

These Terms, their subject matter and their formation are governed by the laws of England and Wales. You and NSKAA LTD agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Site.

24. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision will not be a waiver of that right or provision. These Terms, together with any applicable Project Agreement and our Privacy Policy, constitute the entire agreement between you and NSKAA LTD regarding the Site. You may not assign or transfer your rights under these Terms without our prior written consent.

25. Contact

Questions, comments or requests regarding these Terms can be sent to [email protected]. NSKAA LTD is a company registered in the United Kingdom.
